The bylaws and rules are for the mutual benefit of you and your neighbours. To fully appreciate the community your co-operation is required in complying with the bylaws and rules as set by Park Boulevard community. It will assist the park strata council greatly if your actions and activities show sensitivity to others. 

The bylaws and rules were originally set in 1985. At the 1998 annual meeting of the strata corporation (represented by 95% of the residents comprised of both landowners and tenants) the existing bylaws were reviewed item by item.  Changes were made by those residents in attendance.  The vote was 100% in favour of the new bylaws by all residents. 

The park bylaws and rules are set by the strata corporation.  As required under the strata act of B.C; the bylaws are to be enforced by the strata council. This requirement results in a lot of pressure on the members of the strata council to ensure that the bylaws are upheld (as approved by the majority vote at the 1998 annual meeting). All residents of Park Boulevard need to be familiar with the bylaws of the park so as to not “unknowingly cause problems” which would involve strata council intervention which could result in fines or legal action.   

STRATA BYLAWS WHICH COUNCIL HAD TO ENFORCE IN THE LAST FEW YEARS 

The two most costly infractions ($100 per occurrence)

  1. Pet Infractions:  At the annual meeting it was expressed by the majority that residents should have the option of having a pet.  The pet bylaw is very “liberal in the acceptance of pets”. What is not tolerated in the park is pets doing their business or trespassing on other residents’ property or on common ground.  If you have been given permission to have a pet in this park, please obey the pet bylaws.
  2. Street Parking:  There is to be no street parking period.  

The other common infractions enforced by council:

  1. Visitor parking: This is for your visitors only and not for residents use.
  2. Speed limit: This community is for quiet enjoyment.  As many residents use the roads for walking, we have an intended very slow speed within the community.
  3. Changes to the exterior of the home, lot and landscaping must have permission from the council in writing.
  4. There is to be no junk, vehicles or other stored items in the designated landscaped area of each home.

BY LAWS AND

SCHEDULE OF RESTRICTIONS 

DEFINITIONS

  1. A mobile home is, for the purpose of these restrictions, defined as: a unit designed to be supported on its own wheels or by other means, and arriving at the said lot ready for occupancy apart from incidental operations and connections and shall include modular housing which arrives at the strata lot ready for occupancy apart from incidental operations and connections and which conforms with the following characteristics and specifications:

    (a) designed for long-term occupancy, and originally containing as designed sleeping accommodations, a flush toilet, a tub or shower bath and kitchen facilities with plumbing and electrical connections provided for attachment to outside systems:

   (b) designed as a single family dwelling:

   (c) designed to be transported after fabrication on its own wheels, or on a flatbed or other trailers or detachable wheels:

   (d) arriving at the strata lot where it is to be occupied as a dwelling complete (including major appliances and furniture) and ready for occupancy except for minor and incidental unpacking and assembly operations, location on foundation supports, integration into a prepared structure and the like placed by professional trailer movers to the satisfaction of the Grantor:

   (e) designed as a chattel and intended to so remain even when placed and affixed to the strata lot:

   (f) a minimum of 24 feet wide and 36 feet long if a double wide unit:

   (g) a minimum of 12 feet wide and 56 feet long if a single wide unit;

   (h) must meet CSA-Z240 or CMHC-NBC requirements and to be of a minimum square footage of 672 square feet;

   (i) must be equipped with a natural gas heating system; but does not include trailers, tents, campers, or any other recreational vehicle, artifact or structure.

(2) Park shall be a collective term to describe the strata lots and common areas of the strata plan or either one as the context may require. 

DUTIES OF AN OWNER

(3)  An owner, or lessee of an owner, shall:

    1. only permit a mobile home to be constructed, placed and transported onto his strata lot and attached as a chattel, and ensure that any mobile home so placed conforms to the requirements for a mobile home set out in these restrictions;
    2. when he intends to place a mobile home on his strata lot, have a mobile home moved into the park by professional movers and set up with service connections according to acceptable and professional workmanlike standards. The set up must include a water pressure reducer when pressure is above 60psi.
    3. the mobile home must be set up as low as possible but with a minimum of 24 inches between the pad and the under floor of the home. All homes must be set up according to manufacturers specifications and build pads of a minimum of 10” by 16” placed between the concrete blocks and the pad, all hitches on the mobile home must be detached and the owner must install aluminum or vinyl skirting. All the aforementioned shall be completed within 30 days of occupying the strata lot;
    4. install stairs of a good quality and appearance with a minimum deck or landing size at the front door of 4’ by 6’. Steps or handicap ramps must be skirted to match the factory colour and be approved in writing by the Strata council.
    5. Any landscaping to the lot must be first approved in writing by the Strata Corporation;  All front yards are to be landscaped and maintained. All plants, trees, shrubs, flower beds, lawns, décor rock and landscaped areas must have an approved plan from the Strata Corporation before any changes are made to the lot. There are to be no hedges on the street side of any home as it makes the streets appear very narrow which gives a negative visual impact. Existing hedges on properties at the entrance to the park (lot #1 & #18) are the only exception allowed, but they must be maintained at 3 feet high for safety reasons concerning the visibility of entering and exiting cars. There is to be no landscaping higher than 3 feet in the front or side yards down to the back of the patio and trees must be set back a minimum 5’ from the street. The exception would be for trees within 3 feet across the front of the home and (they must not be more than 6’ high). Back yards behind the homes may have hedges to a maximum 6’ high or 30’ + on the exterior buffer area only. Decorative rock should have a minimum amount of lower type shrubs planted within the design. Landscape area between the homes should be a minimum of 10’ wide with no trees or shrubs over 3’ high and must be planted with either grass or landscaping rock with low ground shrubs and the residents will maintain the same in a proper, reasonable manner ensuring that all lawns are mowed, and together with the flower beds, are weeded and watered so that the lot maintains a neat appearance and condition. (Grandfather rights were given to maintain the existing gravel on lots # 15 Knox, # 29 Whitmore, # 30 Gladstone, # 31 Kelleway, # 47 Lamont.)

        The common buffer area is 15’ to 25’ wide surrounding the park…The trees on this area should be as many evergreens as possible and as high as possible in order to help absorb the noise and pollution of the  traffic surrounding us. This barrier also provides visual protection for us concerning any future development that may occur on adjoining properties. No trees or shrubs may be removed from the common buffer area without permission from the strata corporation. Residents may not park or store vehicles, trailers or other miscellaneous items on landscaped areas in front of or in between the homes.

    1. The owner further agrees to replace where necessary any plants or vegetation which are dead or deceased with similar plants compatible with the landscaping in place.
    2. Maintain and repair his strata lot, mobile home (and maintain the original factory color unless written approval is given by Strata Council to change to another approved park conforming color) and other structures according to these restrictions and the rules and regulations, and should he fail to do so the strata corporation may, on its own accord or by instructing agents, carry out the work necessary at the owner’s expense. (Grand father rights were given to lot # 30 as to the colour of their home.)
    3. install, place and attach the mobile home on the existing support structure only:
    4. attach a lot number not exceeding 4 inches in the front of the mobile home.
    5. Not exceed the speed limit of 15 kilometers per hour in the park.
    6. Utilize and ensure that his guests utilize only those parking spaces so designated by the strata corporation: No parking is allowed on the streets inside the park. If parking is required for a guest and the guest parking provided by the park is full then the park resident must arrange off street space privately outside the park for his guest. The owner or lessees of an owner must utilize and ensure that his guests utilize  only those parking spaces so designated by the strata corporation (12 spaces around the central garden area and the minimum 2 spaces of their ). The 12 designated parking spaces are for the sole purpose of guest parking and there is to be no parking in the 12 parking spaces for residents unless viewing the central garden area or for temporary parking while a guest is using one of their parking spaces on their lot.
    7. Not to install any antennae of any kind but shall utilize only the cable service hook up or if so desired the lot may have one satellite dish that may not be more than 18” across and must be located below the roof line of the home and to be located at the back so as not to be visible from the street or in view of homes that are looking over top of the home.
    8. Shall not place any For Sale or for Rent signs on the windows or on the front lawn or any other advertising or promotional displays. Residents may place a small sign (only) on the real-estate post at the entrance of the park;
    9. Ensure that garbage and refuse is not visible from the common area, provided that on garbage collection days garbage for disposal shall be properly and adequately containerized in plastic or metallic canisters as may be stipulated by The Corporation of the District of Surrey and placed after dark on the night before collection. at a convenient place on the strata lot for collection by the refuse authorities or corporation;
    10. Ensure proper control and the elimination of rodents and disease causing pests on his strata lot and mobile home;
    11. Ensure that adequate fire prevention control is installed and repaired and carry out any construction required by the Fire Department, Engineering or Building Department or the Strata corporation from time to time;
    12. Be responsible for the actions, conduct and safety of himself, family, guest and pets;
 
    1. If so desired, construct a storage shed provided that such shed be built in a proper and workmanlike manner out of good quality materials, consonant with the mobile home, and located at the rear of the lot, provided that there is a minimum 10’ and 39’ surfaced parking area of each strata lot adjacent to and measured from the front curb.  The meaning of the word “consonant” as being in agreement with the siding of the mobile home, usually vinyl or aluminum (and giving grandfather rights to only those buildings already up as of Nov 10th 1988). 

      Fences may be constructed along the lot line behind the patio.  Fences shall not exceed 36” in height; shall be painted on both sides; and shall be approved, in writing, in advance of construction by the Strata Corporation as to design, material and colour.

            The Park was designed to have two vehicles parked on each lot in the driveway extending onto the concrete patio.  No structure shall interfere with the basic guide to allow two cars in each driveway.  Minimum 10’x39’ surface parking area measuring from the front curb must be maintained.  There is to be no parking on the street or on the designated landscaped areas of each lot.  Each lot has a concrete patio area of 14 x 27 and an area approved for storage sheds whether it has grass or landscaping rock on it.  The driveway width may be increased as long as it does not come closer than 3’ from the property line of the next lot and 8’ from the next home.  The length may be extended to the back of the lot.  (Corner lots may not pave the landscaped area open to the street unless there is a minimum 10’ of landscaping on the street side).  Driveways may not be increased without a plan approved of by the strata corporation (in writing) as to its design and suitability to the Park.   

    1. If so desired, construct a deck, provided that such deck will be of a design compatible and complementary to the home, and must comply with all Municipal By-laws and be approved by the strata corporation “in writing” and provided further that it is set back a minimum of 6’ from the front of the mobile home. 
 
    1. If desired, construct a free standing carport provided that it is built in a proper and workmanlike manner out of good quality materials and approved by the strata corporation in writing and provided further that it is set back a minimum of 6’ from the front of the mobile home.
 
    1. Not store or park or permit to be stored or parked any truck over three quarter tons, boat, trailer or camper except in designated areas.  The designated area for trailers, campers and motor homes is on the owners lot provided that the unit is set back from the front corner of the home and still allows 10’ x 39’ surfaced parking area.  (some corner lots with patios on the street-side would not have a designated area except behind the home if it is not common property.

      Parking for more than 24 hours of trailers, campers and motor homes is not permitted in driveways. 

      Vehicles,   motor-homes, campers, trailers, motorbikes parked on the street will be subject to a fine of $100.00 per day.  Fire regulations do not permit parking on the narrow streets of our park. 

 

    1. Not engage in any automobile repair or motorcycle repairs, will be permitted in      

          the park and at no time have a motor vehicle placed on blocks; 

    (w)  not build boats or repair outboard motors;  

    1. not construct an outdoor clothes line or permit outdoor clothes drying, except an          

          umbrella type clothes line, which should be placed at the rear of the owner’s strata  

          lot.  

    1. Permit the strata corporation and its agent, at all reasonable times on notice (except in case of emergency, when no notice shall be required) to enter his strata lot for the purpose of inspecting cables, and ducts for the time being existing in the strata lot and capable of being used in connection with the enjoyment of any other strata lot or common property, or for the purpose of maintaining, repairing or renewing common property, common facilities or other assets of the strata corporation, of for the purpose of ensuring that the restrictions are being observed;
    2. The strata corporation will have 5 council members, one of the five may be a tenant in good standing of the community, and the others shall be landowners
 
    1. repair and maintain his strata lot and home including windows and doors and areas allocated to his exclusive use, and keep it in a state of good repair;
 
    1. use and enjoy the common property, common facilities, or other assets of the strata corporation in a manner that will not unreasonably interfere with the use and enjoyment thereof by other owners or their families or visitors.  The Strata Corporation is not liable for mishaps, accidents, or injury which may occur in the central garden area or common areas.  Residents acknowledge that the park provides no supervision whatsoever in these areas and residents use of the same is entirely at residents own risk.  No child is allowed in the central garden area without total supervision of an adult. 

      All persons must stay on the pathways when viewing central park area.  Residents shall observe central garden area rules, as posed in those locations, and as are in existence from time to time.  

    1. Not use his lot, or permit the same to be used, in a manner or for a purpose that will cause a nuisance or hazard to any occupier of a lot (whether an owner or not) or his family.  No television, radio, stereo or other noise will be permitted between 11 p.m. and 8:00 a.m. and no unusually disturbing noise will be permitted at any time.  The determination of what constitutes “Unusually disturbing” shall be made by the strata council whose decision is final.  Residents shall not do or permit to be done on his lot or in his home anything which may or can tend to cause the justifiable annoyance of other residents.  No littering, games, skateboards, rollerblades or racing will be allowed between the lots or on the streets inside the park.

      Residents shall not set any open fires in the park (save a charcoal grill used for barbecue purposes). 

    1. notify the strata corporation promptly upon any change of ownership, upon a written offer of sale of the property the strata council would request contact with a new resident (before occupancy) in order to be sure they have a copy of the park bylaws and to give them an opportunity to discuss the bylaws or of any mortgage or other dealing in connection with his strata lot;
 

    (ff)  receive the written permission of the strata council before undertaking any   

           alterations of the exterior of any mobile home or to the construction of any       

           carport, cover, patio, storage shed, skirtings or any similar object which

           permission shall only be given so as to conform with these restrictions and shall

           not otherwise be unreasonably withheld.  Maintenance such as painting the same

           color does not need approval but a change in color consists of an alteration and

           does require strata corporation approval in writing.   

    1.   must use his strata lot and mobile home for residential purposes only.
 
    1. An owner, or lessee of an owner shall: not use his mobile home nor permit his mobile home to be used to accommodate, either temporarily or permanently more than two (2) persons, except that he may accommodate up to four (4) persons if all four (4) persons are related by blood, adoption or marriage. This park was designed in 1985 for adults only and the minimum age is 45.  Visiting grandchildren are welcome but if they are to be guests in your home for longer than 2 weeks please notify the strata corporation in order to receive permission for this privilege.
 
  
  1. Not solicit, nor permit any person to solicit, door to door within the park.
 
  
  1. The use of snowmobiles is prohibited in the park.
 

    (nn)   No commercial business of any nature (including daycare) may be conducted by a

             resident in or on the area of the park.

PET BYLAWS & AGREEMENT

PETS 

Residents must obtain written permission from the Strata Council to keep a house pet in this community and must execute a Pet Bylaw and Agreement. The resident understands and agrees that the following are the only pets allowed in Park Boulevard community pursuant to the community’s bylaws and regulations. The pet population is controlled by the Strata Corporation and no pet, whether mammal,  reptile, insect or arachnid, may be brought into the park or acquired after occupancy commences without the prior written approval of the Strata Corporation. 

  1. Only one “small breed” of dog, defined as not to exceed 25 pounds and / or 15 inches in height when fully mature.
  2. And two house cats  (never to be let outside to roam unless it is on a leash).
 

The resident agrees to comply with any provincial or local government laws, regulations or bylaws governing the proper inoculation and licensing of any pet allowed to remain in the Community. 

RESIDENT ALSO AGREES TO THE FOLLOWING: 

If a dog is allowed in the community: 

  1. Disturbances such as barking, snarling, growling, etc. which will annoy your neighbors are cause for revoking permission to keep your pet.
  2. Any dog when not inside your manufactured home or contained within a fenced yard, must be on a short (6 foot) leash, and kept off neighbors lawns, common areas, grass boulevards.
 

REGARDLESS OF THE TYPE OF PET: 

  1. No pet is to invade the privacy of any other resident’s home site, flower beds, shrubs, lawns, yard, etc.
  2. No pets are permitted in the central garden area or common landscaped areas, or the King George Hwy grassed area.
  3. Droppings must be picked up and disposed of immediately.
  4. Pet owners are required to keep their own “lot” cleaned of droppings to prevent any unsanitary or unsightly condition or odor which may offend their neighbors.

If a resident loses a pet, written permission must be acquired from the strata council before replacing the pet. If a pet is obtained without written permission from the strata council, the strata council can have the pet removed from the community.

In the event the strata community revises the Bylaws and Regulations to prohibit pets in the community, the residents shall not have the right to replace the pet. 

No pet is allowed to run at large in the community. 

There will be no Pit-Bulls, Bull Terriers, Rottwellers, Doberman Pinschers, German Shepherds or other such intimidating dogs allowed in the community.  The breed of the dog must be approved by the strata council. 

The park community encourages that pets be spayed or neutered. No breeding of any pet will be approved within the community. Any resident found to be breeding an animal will lose the privilege of keeping a pet in the community.
